TERMS AND CONDITIONS ADFTC001
1. This agreement entitles the nominated agent the rights to exclusive work bookings and enquiries within a minimum 10 mile radius around the selected area as detailed below. The nominated agent must service all leads received during business hours, on a daily basis. All quotes that can not be written out during the onsite appointment, must be presented within 24 hours of a site visit.
2. All work carried out by All Day Fencing and nominated agents must comply with the Building Code of each state where required. All work must be carried out in a professional and ethical manner as stipulated by the relevant licencing authority.
3. All Day Fencing agents must operate their own registered trading company and are responsible for the taxation obligations, legal obligations and management of the agency.
4. All Day Fencing agents must carry and maintain the appropriate trade licences as required by the licencing authority.
5. All Day Fencing agents must carry suitable Public Liability insurance ($5 mil cover min).
6. All Day Fencing agents must pay for their own promotional products as required.
7. All Day Fencing accepts no responsibility, nor legal liability or financial loss in any way as a direct result from the performance of a nominated agent or the performance of any subcontractors engaged by the agent.
8. All Day Fencing makes no representation as to the amount of work that will be generated in each area or the financial success of the agency, or for the capability of the agent to perform.
9. The nominated agent may terminate their obligations under this contract by providing written notice of their intention to All Day Fencing. In the event of termination the agent acknowledges that all work leads and client referrals remain the property of All Day Fencing. The agent is required to forward any work leads or approved jobs to the All Day Fencing head office or, as directed, to the new agent.
10. All Day Fencing reserve their rights to claim the monthly agency fee and any related expenses in full as detailed below, for any work performed in breach of the terms and conditions of this agreement.
11. Agency fees are reviewed annually each July. All Day Fencing retains the right to increase or adjust the agency fee in line with annual increases in inflation.
12. All property supplied to the nominated agent, including but not limited to Product Books, Pricelists, Trade Contacts, Material suppliers, remains the property of All Day Fencing is to be treated with confidentiality.
13. All other establishment fees, taxation obligations, management costs and expenses acquired through the running of the business are to be covered by the nominated agent. All Day Fencing accepts no liability for any financial loss or expense incurred by the agent in the performance of their business.
14. All Day Fencing retains the rights to terminate this agreement at any time at their sole discretion for any breach of any of the terms or conditions of this contract.
15. All Day Fencing agencts may on-sell their branch to a new applicant approved by All Day Fencing, as long as the Terms and Conditions of this contract are met by the new applicant, including the payment of the monthly fee's.
16. All Day Fencing retain the rights to adjust the terms of this agreement at their discretion as long as it does not impede, nor effect the profitability or performance of the nominated agent.
